1. Agreement to Terms
By accessing or using the Lumepixa mobile application or web portal ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Lumepixa provides:
- AI-powered transformation of product photos into professional, store-ready images
- Photo gallery management (mobile and web portal)
- Support for major e-commerce platforms (Amazon, Shopify, Etsy, eBay, and more)
3. User Accounts
3.1 Account Creation
- You must provide a valid email address
- You must be at least 13 years old to use the Service
- You are responsible for maintaining account security
- You must not share your account credentials
3.2 Account Termination
- You may delete your account at any time via Profile settings
- We may terminate accounts that violate these Terms
- Upon termination, all your data will be deleted within 30 days
4. Credits and Purchases
4.1 Credit System
- Lumepixa uses a credit-based system for photo processing
- 1 credit = 1 complete product photo
- Credits are purchased as one-time credit packs (not a subscription)
- Credits do not expire
- Credits are non-transferable between accounts
4.2 Payments
- Credit packs are purchased through Apple App Store or Google Play Store
- Payment management is handled by RevenueCat
- Pricing varies by region (see in-app pricing)
4.3 Refunds
- Refunds are handled by Apple App Store or Google Play Store according to their policies
- Contact their support for refund requests
- Used credits cannot be refunded
5. Acceptable Use
5.1 You Agree NOT To:
- Use the Service for any illegal purpose
- Share your account with others
- Attempt to hack, reverse engineer, or decompile the app
- Upload malicious content, viruses, or inappropriate images
- Abuse the AI processing system
- Scrape or automate data collection from the Service
- Use the Service to infringe on intellectual property rights of others
- Upload images you do not have the right to use
5.2 Content Guidelines
- Photos submitted must be legitimate product images
- Do not upload offensive, explicit, or inappropriate content
- You are responsible for ensuring you have rights to the images you upload
6. Intellectual Property
6.1 Our Rights
- Lumepixa name, logo, and app design are our trademarks
- App code, features, and design are protected by copyright
6.2 Your Rights
- You own the original product photos you upload
- You have a license to use the AI-generated output images for commercial purposes (e.g., e-commerce listings)
- You can download and use generated images without restriction
6.3 License to Use Service
- We grant you a limited, non-exclusive, non-transferable license to use the Service
- License is revoked if you violate these Terms
7. AI-Generated Content
7.1 Output Images
- Product photos are processed using generative AI
- AI-generated scenes and backgrounds are created based on your selected preset
- Results may vary and are not guaranteed to be identical each time
- You should review output images before using them in your listings
7.2 AI Limitations
- AI may occasionally produce imperfect results
- Product appearance may slightly differ from the original in generated scenes
- You are responsible for verifying the quality of output images before use
- We do not guarantee that generated images meet specific marketplace requirements
8. Disclaimers
8.1 Service Availability
- We provide the Service "AS IS" and "AS AVAILABLE"
- We do not guarantee 100% uptime
- We may perform maintenance that temporarily disrupts service
- AI processing times may vary depending on server load
8.2 No Warranties
- We make no warranties about the accuracy of AI-generated images
- We do not guarantee specific e-commerce platform compliance
- We are not responsible for third-party service failures
9. Limitation of Liability
To the maximum extent permitted by law:
- We are NOT liable for indirect, incidental, or consequential damages
- We are NOT liable for rejected or non-compliant marketplace listings
- We are NOT liable for data loss (though we take reasonable precautions)
- Our total liability is limited to the amount you paid in the last 12 months
10. Indemnification
You agree to indemnify and hold Lumepixa harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Privacy
Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of new Terms.
13. Termination
13.1 By You
- Delete your account anytime via Profile settings
- All data will be permanently deleted within 30 days
- Unused credits are forfeited upon account deletion
13.2 By Us
We may terminate your account if you:
- Violate these Terms
- Abuse the AI processing features
- Engage in fraudulent activity
14. Dispute Resolution
Before filing a claim, contact us at support@qedamio.app to resolve disputes informally. Disputes will be resolved through binding arbitration conducted in English. You agree to resolve disputes individually, not as part of a class action.
15. Governing Law
These Terms are governed by applicable international laws.
- For EU users: EU consumer protection laws apply
- For California users: California consumer laws apply
16. General
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, along with the Privacy Policy, constitute the entire agreement between you and Lumepixa. Our failure to enforce any provision does not constitute a waiver of that provision.
